Chapter 1. General Provisions

Article 1 (Purpose)

These Terms set forth the rights, obligations, and responsibilities of users of the Calcat website (https://www.calcat.ing) and the 'Calcat' mobile application (hereinafter "Calcat"), operated by Uyoung Co., Ltd., and of the stores provided through the website and the application, with respect to their use of the services provided by Calcat (hereinafter the "Service").

Article 2 (Definitions)

① "Calcat" means the virtual place of business established by Uyoung Co., Ltd., using computers and other information and communications equipment, to provide goods or services (hereinafter referred to as "goods", "goods etc.", "service", or "services etc.") to users, and is also used to refer to the business operator of the "Calcat Store".

② "User" means a member or non-member who accesses Calcat and receives the Service provided by Calcat under these Terms.

③ "Member" means a person who has registered as a member of Calcat and may continuously use the Service provided by Calcat.

④ "Non-member" means a person who uses the Service provided by Calcat without registering as a member.

⑤ "Store" means the Calcat Store available within the Calcat website or application.

⑥ "Coupon" means an online/mobile coupon, exclusive to Calcat, that allows the User to place an order at a discount equal to the amount or rate shown on the coupon when purchasing goods or services sold in the Store.

⑦ "Point" means a means of payment granted by Calcat to a User upon completion of certain actions specified in Article 16 of these Terms, such as inviting a friend, which the User may use when purchasing goods or services in the Store.

Article 3 (Display, Explanation, and Amendment of the Terms)

① Calcat shall make the contents of these Terms available to users via a separate linked page within the website service screen so that users can easily understand them.

② Before users agree to these Terms, Calcat shall provide explanations or linked screens on a separate page so that users can understand important content of the Terms, such as withdrawal of subscription, delivery responsibilities, and refund conditions.

③ Calcat may amend these Terms within the scope that does not violate applicable laws. When these Terms are amended, Calcat shall announce the effective date and reason for the amendment through service notices from 7 days before the effective date until the day before the effective date. However, where the change is unfavorable to users, Calcat shall announce it at least 30 days before the effective date. In such case, Calcat shall clearly compare the pre- and post-amendment content so that users can easily understand it, and where individual notice is required for unfavorable changes, Calcat shall notify each member individually by email or other means.

④ Where Calcat has clearly notified, in the announcement above, that failure to express refusal within 7 days from the announcement date until the effective date of the amended Terms will be deemed consent to the amendment, and a member does not expressly refuse during that period, the member shall be deemed to have agreed to the amended Terms.

⑤ When Calcat amends these Terms, the amended Terms apply only on or after the effective date, and if a member does not agree to the amended Terms, the company cannot apply the amended Terms to that member, and the member may terminate the Service agreement. In such case, if there are special circumstances under which the company can no longer apply the existing Terms to a member who has not agreed to the amended Terms, the company may terminate the Service agreement with that member.

Article 4 (Notice to Members)

① When Calcat gives notice to members, it may use information registered by the User at the time of a transaction request to notify by text message, email, app push, or similar means.

② For notices or communications to an unspecified number of members, Calcat may replace individual notices by posting on the Calcat bulletin board for 7 days or longer. However, Calcat shall give individual notice with respect to matters that have a material impact on a member's own individual transactions.

Article 5 (Formation of the Service Agreement)

① A Service agreement is formed when the User fills in the membership information in the sign-up form specified by Calcat, agrees to these Terms and to the collection of personal information, and the company accepts the application for Service after verifying the User's information.

② Calcat shall register a User who has applied for membership as a member unless the User falls under any of the following. If a User falls under any of the following, Calcat may refuse or withhold acceptance of the application:

  1. Where the User has been subject to a use restriction or has previously lost member status due to violation of these Terms or detailed guidelines; provided, however, that this does not apply to a person who has obtained Calcat's approval for re-registration after 3 years have passed since the use restriction or loss of member status.
  2. Where there are false statements, omissions, or errors in the registered information.
  3. Where the application for Service is made by misappropriating the personal information of another person, such as another person's name.
  4. Where the User resides or stays in a country where the company cannot provide the Service, or applies for the Service through an address in such country.
  5. Where it is objectively judged that the User is not a normal Service user.
  6. Where it is otherwise judged that registering the User as a member will cause technical or operational problems or significant difficulties for Calcat.

③ When there is a change to the information registered at the time of sign-up, a member shall, within a reasonable period, notify Calcat of such change by amending the member information. Calcat shall not be liable for damages resulting from the member's failure to update such information.

Article 6 (Suspension and Change of the Service)

① Unless otherwise indicated or announced within the Service, Calcat shall make best efforts to provide the Service to users year-round. However, the provision of the Service may be temporarily suspended where there are technical reasons, repair, inspection, replacement, or breakdown of information and communications equipment such as computers, interruption of communications, regular inspections, electronic intrusions such as hacking, suspension as a result of dispositions by government agencies, or force majeure events such as natural disasters or national emergencies. Calcat shall provide notice of such temporary suspension before or after the fact without undue delay.

② Calcat may suspend part or all of the Service for technical or operational reasons. In such case, Calcat may suspend the Service after announcing it 30 days in advance. However, where there are unavoidable circumstances such as critical bugs, server equipment defects, urgent security issues, or urgent management circumstances, Calcat may give notice within a shorter period than 30 days or after the fact.

③ Where Calcat is unable to provide the Service due to a change of business, abandonment of the business, or a merger between companies, Calcat shall notify users 30 days in advance, and shall compensate consumers in accordance with any conditions Calcat has previously presented. If Calcat has not presented such conditions in advance, Calcat shall be discharged from liability by paying the User any remaining mileage or reserve points so that the User can use them within Calcat for a certain period.

Article 7 (Withdrawal of Membership and Loss of Membership)

① A member may request withdrawal at any time, and Calcat shall process the withdrawal immediately.

② Calcat may restrict or suspend a member's qualifications where the member falls under any of the following:

  1. Where the member has registered false information at the time of applying for membership.
  2. Where the member fails to pay, on the due date, the price of goods purchased through Calcat or other debts that the member owes in connection with the use of Calcat.
  3. Where the member threatens the order of electronic commerce by interfering with another person's use of Calcat or by misappropriating their information.
  4. Where, by using Calcat, the member engages in any act prohibited by law or by these Terms or contrary to public order and morals.

③ Where, after Calcat has restricted the member's qualifications, the same conduct is repeated two or more times or the cause is not corrected within 30 days, Calcat may revoke the member's qualifications.

④ Where Calcat revokes a member's qualifications, the member's registration shall be deleted. In such case, Calcat shall notify the member and shall give the member at least 30 days to present an explanation before deleting the member registration.

Article 8 (Protection of Personal Information)

When collecting users' personal information, Calcat collects and uses only the minimum personal information necessary within the scope required to provide the Service. For details, please refer to Calcat's Privacy Policy.

Article 9 (Obligations of Calcat)

① Calcat shall maintain a security system to protect users' personal information (including credit information) so that users can use the Service safely, and shall make best efforts to provide the Service by maintaining and inspecting the facilities required for the provision of the Service.

② Calcat shall not send commercial advertising emails for profit-making purposes that the User does not wish to receive.

③ Calcat sends real-time notifications regarding important health information, such as blood glucose, that have a significant impact on members' health management, in order to inform members in a timely manner. Such messages are sent to fulfill the company's service obligations and do not constitute advertising messages.

Article 10 (Obligations of Users)

① A User must not allow any third party to use their ID and password. If a User becomes aware that their ID or password has been stolen or is being used by a third party, the User shall immediately notify Calcat and follow any instructions provided by Calcat.

② Users shall not engage in any of the following acts:

  1. Registering false information at the time of applying for or modifying use of the Service.
  2. Misappropriating another person's information (personal information, member information, sensitive information, etc.), impersonating another person, or otherwise using such information improperly.
  3. Sharing the member's own account registered for the Service with any third party for use, or transferring, assigning, or pledging the right to use the Service or any other position under the Service agreement to another person.
  4. Reproducing, distributing, modifying, altering, disguising the source of, or commercially using any information or content posted on Calcat without the company's consent.
  5. Interfering with the operation of the Calcat Service or transmitting information that may interfere with such operation.
  6. Posting or linking obscene or violent messages, images, sounds, or other information contrary to public order and morals on Calcat's service bulletin boards or similar.
  7. Continuously sending words, sounds, text, images, or videos that cause shame, disgust, or fear to the other party.
  8. Posting content or sending emails or messages to other members while impersonating an employee or operator of Calcat.
  9. Copying, modifying, distributing, selling, transferring, lending, or pledging the Service or any software included therein, or allowing others to use it, or attempting to reverse engineer or extract source code from the software, or otherwise reproducing, disassembling, imitating, or modifying the Service, without Calcat's consent.
  10. Harassing other users through abusive false or malicious reporting.
  11. Using the Service for the member's own commercial purposes without the company's prior consent, including by posting or transmitting promotional information within the Service.
  12. Interfering with the business of Calcat or any third party, or damaging the reputation of another person (including the company), in the course of using the Service.
  13. Infringing the copyright or other rights of Calcat or any third party.
  14. Violating the Calcat Store operating guidelines or similar.
  15. Otherwise acting against the legitimate interests of Calcat or obtaining undue benefits, or acting contrary to public order and morals or the customs of electronic commerce.

③ Users shall comply with the matters set forth in these Terms and with the Service usage guides, usage guidelines, and precautions announced by Calcat.

④ Users may not engage in any business activities using the Service without Calcat's prior written approval, and Calcat shall not be liable for the results of such business activities or for any results arising from a member's business activities in violation of these Terms. If Calcat suffers damages due to a User's business activities, the User shall compensate for such damages.

Article 11 (Termination of the Service Agreement)

① A member may apply for withdrawal or termination of the Service agreement at any time through the menu within the Service, and the company shall process it in accordance with applicable laws. However, where necessary procedures must be completed, withdrawal shall be processed after all such procedures are completed.

② Upon termination of the Service agreement, the member's information and other data shall be deleted, except for exceptions under applicable laws and Calcat's Privacy Policy.

③ Calcat may terminate the Service agreement with a User and revoke the User's qualifications without prior notice in any of the following cases:

  1. Where the member has died.
  2. Where the member has misappropriated another person's personal information or mobile device.
  3. Where it is found that personal information provided by the member at the time of sign-up is false.
  4. Where the member has earned or used Points by improper means.
  5. Where the member threatens the order of electronic commerce by interfering with other members' use of the Service.
  6. Where the member impersonates the company, an operator, or an officer or employee outside the Service.
  7. Where the member threatens the system by modifying the company's client program or hacking the server without authorization.
  8. Where the member damages the company's reputation or credit, or interferes with its business, by spreading false information, deception, or other means.
  9. Where the member engages in spam-type promotional activities relating to the Service.
  10. Where the member otherwise acts in violation of these Terms, detailed guidelines, or applicable laws.

④ For a User notified of loss of qualification under item 1 above, the User's Points may be used to purchase partner content within 7 days from the date of notice (the "remaining Points resolution period"). After such period, any remaining Points shall be extinguished.

⑤ For a User notified of loss of qualification under items 2 through 10 above, the User's Points shall be extinguished immediately upon notice, and the User may not raise any objection.

⑥ Where any of the foregoing grounds exists, Calcat may impose a use restriction in lieu of loss of qualification at its discretion.

Chapter 2. Calcat Store Usage Guidelines

Article 12 (Provision and Change of the Service)

① The services that Calcat provides through the Calcat Store are as follows:

  1. Providing information on goods etc. and concluding purchase agreements.
  2. Delivering goods etc. for which a purchase agreement has been concluded.
  3. Providing various types of information related to electronic commerce that the company offers.
  4. Services for members and other tasks determined by the company.

② Where goods etc. are out of stock or technical specifications change, the company may change the content of the goods etc. to be provided under agreements concluded in the future. In such case, the company shall promptly announce the changed content of the goods etc. and the date of provision in the location where the current content of the goods etc. is posted.

③ Where the content of services that the company has agreed to provide to a member must be changed due to reasons such as goods etc. being out of stock or technical specification changes, the company shall immediately notify the member of the reason.

④ In the case of the preceding paragraph, the company shall compensate the member for any damages incurred. This shall not apply, however, where the company proves that there was no intent or negligence.

Article 13 (Purchase Request)

① Users shall make purchase requests at the Calcat Store in the following manner or a similar manner, and Calcat shall clearly provide the following information when the User makes a purchase request:

  1. Searching for and selecting goods etc.
  2. Entering the recipient's name, address, telephone number, email address (or mobile phone number), etc.
  3. Confirmation of the contents of the Terms, services for which the right of withdrawal is restricted, costs such as shipping and installation fees, and similar matters.
  4. Indication of agreement to these Terms and of confirmation or refusal of the items in paragraph 3 above (e.g., by mouse click).
  5. Submitting a purchase request for goods etc. and confirming or agreeing to Calcat's confirmation thereof.
  6. Selection of payment method.

Article 14 (Formation of Purchase Agreement)

① Calcat may decline a purchase request where any of the following applies. However, when entering into an agreement with a minor, Calcat shall notify the minor or their legal representative that the minor or the legal representative may cancel the agreement if the legal representative's consent is not obtained:

  1. Where the application contains false information, omissions, or errors.
  2. Where accepting the purchase request would otherwise cause significant technical problems for Calcat or be contrary to its legitimate interests.

② An agreement is deemed formed when Calcat's acceptance, in the form of a receipt confirmation notice, reaches the User.

③ Calcat's manifestation of acceptance shall include information such as confirmation of the User's purchase request, availability of sale, and the ability to correct or cancel the purchase request.

Article 15 (Coupons)

① "Coupons" are issued to Users with or without consideration. Calcat may set the eligibility, method, period, and discount amount of a Coupon so that the User can apply the Coupon when purchasing goods or services in the Store, and the types or content of Coupons may vary in accordance with Calcat's policy.
